The Client further understands there is no guaranteed placement or rank on the Search Engines and that a new website will take up to 6 months to appear on SERP (Search Engine Result Pages). mjward.co.uk does not control Search Engine algorithms and huge shifts can appear daily, weekly and even hourly.
Payment Terms for a mjward.co.uk Website Design
A non refundable deposit of 50% of the total fee payable under these terms and conditions is due immediately upon the starting of any project. The remaining 50% shall become due when the work is completed to the satisfaction of the client. mjward.co.uk reserves the right not to begin the Work until the said deposit has been paid in full. The fee quoted in the contract does not include the cost of domain registration, hosting set up fee or hosting unless otherwise stated in the invoice.
Supply of Materials to mjward.co.uk
The Client is to supply all materials and information required for mjward.co.uk to complete the Work in accordance with the agreed specification. Such materials may include, but are not limited to, photographs, written-copy, logos and other printed materials.
Where the Client's failure to supply such materials leads to a delay in completion of the work, mjward.co.uk has the right to extend previously agreed deadlines for the completion of the Work by a reasonable amount. Where the Client's failure to supply materials prevents progress on the Work for more than 21 days, mjward.co.uk has the right to invoice the Client for any part or parts of the Work already completed.
Consequential Loss
Under no circumstances will mjward.co.uk be responsible or liable for financial or other loss or damage caused by the failure or use or misuse of its software or Investment, or Marketing Recommendations.
Approval of Work
On completion of any website design work, the Client will be notified and have the opportunity to review it. The Client should notify mjward.co.uk, in writing, of any unsatisfactory points within 7 days of receipt of such notification. Any of the Work which has not been reported in writing to mjward.co.uk as unsatisfactory within the 7 day review period will be deemed to have been approved.
Offers and Proposals
Offers and proposals made by mjward.co.uk to potential clients should be treated as trade secrets and remain the property of mjward.co.uk. Such offers and proposals or the information contained within them must not be passed to third parties or publicly disseminated without prior written authorization from mjward.co.uk. This includes, but is not limited to, technical features, functionality, aspects of web design, investment, marketing and pricing information.
Warranty by Client as to Ownership of Intellectual Property Rights
The Client will obtain all the necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trademarks or any other material it supplies to mjward.co.uk for inclusion on the Website. The conclusion of a contract between mjward.co.uk and the Client shall be regarded as a guarantee by the Client to mjward.co.uk that all such permissions and authorities have been obtained and that the inclusion of such material on the Website would not constitute a criminal offence or civil delict. By agreeing to these terms and conditions, the Client removes the legal responsibility of mjward.co.uk and indemnifies the same from any claims or legal actions however related to the content of the Client's site.
Website Updates and Maintenance
mjward.co.uk takes no responsibility for the functionality or maintenance (unless a maintenance contract is in place) of the Website after the Work has been completed. Errors (both technical and typographical) attributable to mjward.co.uk will not be corrected free of charge, mjward.co.uk reserves the right to charge a reasonable fee for correction of errors for which mjward.co.uk is not responsible, including, but not limited to malicious modification of the Website by a third party and typographical errors contained in materials provided to mjward.co.uk by the Client.
Laws Affecting Electronic Commerce
From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend mjward.co.uk and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client's exercise of Internet electronic commerce.
The land investment enquiry form
All land enquiries are forwarded to a trusted team of land experts that I ‘Michael Jon Ward’ have personally used to purchase land in the past. Please note that mjward.co.uk is acting as an agent helping investors find the perfect plot. All land sold is simply sold as either being Agricultural or Forestry land or a mixture of both. Although after purchase you may apply for Planning Permission for a change of use, we do not imply that permission for change of use will be granted for any land sold by us.
All land sold is Freehold Land meaning that once you have bought it then it will belong to you and your heirs forever and the owner will have no future claim on the land whatsoever. All items upon and beneath the land bought by you becomes yours the moment that the plot has been paid for by CHAPS, AFTS, CASH, CARD or On-Line and upon cheque clearance if paid by CHEQUE or BANKERS DRAFT. Therefore you become responsible for what you do with the land and the items upon or beneath the land from the time the land becomes yours.
Recent copies of Land Registry Title of Ownership and Charges Register / Covenants are available upon request. Note that we only searches the Land Registry (to establish ownership and to do a legal conveyance) and do not do local Council searches. Please note that in the exceedingly rare cases that a local council is owed money by an owner of land this would normally appear as a charge on the above mentioned Land Registry search.
